BST Airsoft – End User License Agreement (EULA)

Effective Date: April 17, 2025

BST Airsoft operates the BST Airsoft website (https://bstairsoft.com), iOS app, and Android app (collectively, the “Service”), a platform for buying, selling, and trading airsoft gear. This End User License Agreement (EULA) governs use of the Service.

By using the Service, users agree to these terms. If these terms are not accepted, the Service may not be used.

1. Acceptance of Terms

By creating an account, browsing listings, messaging users, or posting content, users affirm that this EULA has been read, understood, and agreed to.

2. Purpose of the Platform

BST Airsoft is a community-driven platform designed to connect airsoft players for buying, selling, or trading airsoft-related gear. BST Airsoft does not participate in or facilitate transactions between users, acting neither as a broker, intermediary, nor guarantor. All transactions are solely between users, who assume all responsibility and risk for interactions, trades, or exchanges.

2A. Flexibility in How Users Trade

The Service encourages local, in-person trades, particularly at airsoft fields, but users may coordinate trades as mutually agreed, including:

• Meeting at locations not listed in the Service.
• Using local pickup or private arrangements.
• Shipping items, if both parties consent.

BST Airsoft does not supervise or verify trade locations or methods. Users choosing to ship items do so at their own risk, including risks of fraud, lost packages, or disputes. Proper precautions and verification of trading partners are recommended.

2B. Transaction Terms and Disputes

All transaction terms—such as price, item condition, payment method, and returnability—must be determined solely between users. BST Airsoft is not a party to transactions and does not enforce, mediate, or guarantee any deal. No buyer or seller protections, refunds, or dispute interventions are offered. Users are responsible for ensuring clear, mutually understood terms.

2C. Reporting Fraud or Abuse

Reports of scams, fraud, or harassment may be submitted through the Service’s reporting system. Reports are reviewed within 24 hours, and actions may include:

• Investigating the reported user.
• Removing listings.
• Suspending or banning accounts violating platform rules.

2D. User Safety Guidelines

To promote safe transactions, the following precautions are strongly recommended:

• Meet at Official Airsoft Fields: Conduct in-person trades inside an official airsoft field, within the presence of the establishment (not outside), for a safe, controlled environment.
• Verify Trading Partners: Confirm the identity and trustworthiness of trading partners before exchanging items or payments, using profile checks, references, or thorough communication via the Service’s messaging system.
• Inspect Items Thoroughly: Inspect items in person to ensure they meet criteria and condition, testing functionality and seeking secondhand opinions from players, field staff, or technicians if needed.
• Ask Probing Questions: Inquire about item history, condition, or use to uncover potential issues.
• Avoid Public Meetups: Trading in public areas is highly discouraged. Choose private, airsoft-friendly locations like airsoft fields to ensure a secure and appropriate setting.
• Prefer In-Person Trades: In-person trades are generally safer than shipping, reducing fraud risk and allowing immediate inspection.
• Safe Shipping Practices: If shipping items, take precautions:
• • Use trusted payment platforms like PayPal, which offer Buyer and Seller Protection for eligible transactions.
• • Ship with trackable services and consider insurance for high-value items.
• • Document item condition with photos before shipping and retain proof of shipment.
• • Avoid untraceable payment methods like cash, wire transfers, or cryptocurrency.
• • Communicate shipping terms through the Service’s messaging system to maintain a record.

BST Airsoft provides reporting tools and moderates content to address fraud or abuse but does not guarantee transaction safety or outcomes. Users are solely responsible for protecting themselves.

3. Intended Use

BST Airsoft is intended exclusively for airsoft-related items and accessories and is restricted to users aged 17 and older. Users under 17 must obtain parental consent. The following are prohibited:

• Real firearms or regulated firearm parts (e.g., receivers, frames, or other components restricted by law).
• Ammunition (live or inert), explosives, or pyrotechnics.
• Suppressors, silencers, or other regulated equipment.
• Knives, edged weapons, or tactical gear prohibited by law (e.g., restricted body armor, night-vision devices).
• Counterfeit, stolen, or fraudulent items.
• Items or activities violating local, state, federal, or international laws, including applicable airsoft regulations (e.g., age restrictions, local laws).

Users are solely responsible for ensuring compliance with all applicable laws, including federal, state, and local airsoft regulations.

4. User-Generated Content

Users are solely responsible for content uploaded or shared. The following content is prohibited:

• Illegal, abusive, harassing, threatening, or hateful content.
• Obscene, pornographic, or sexually explicit material.
• Defamatory, fraudulent, or misleading information.
• Content promoting violence or discrimination.
• Spam, malware, or harmful code.
• Content infringing intellectual property or other rights.

BST Airsoft enforces a zero-tolerance policy for objectionable content and abusive behavior. Violations may result in content removal and account suspension or termination.

5. Commercial Use

BST Airsoft welcomes personal and commercial use, including small-scale sellers, hobbyists, and creators of custom or secondhand airsoft gear. The Service is intended for unique, used, or bespoke airsoft equipment, not mass-produced or off-the-shelf items commonly available at major retailers. Listings inconsistent with this community-driven purpose (e.g., bulk retail inventory, non-airsoft products) may be removed at BST Airsoft’s discretion. Removal decisions can be appealed by visiting https://bstairsoft.com/contact-us/ within 7 days, with reviews completed within 48 hours.

6. Platform Availability and Changes

BST Airsoft is provided “as is” and “as available.” No guarantees are made regarding:

• Continuous uptime or uninterrupted access.
• Availability or preservation of content or user data.
• Future access to specific features or functionality.

Features may be changed, disabled, or removed at any time without notice or liability.

7. Limitation of Liability

BST Airsoft strives to provide a reliable platform but is provided “as is” and “as available.” To the fullest extent permitted by law, liability is disclaimed for damages or losses resulting from:

• User interactions, transactions, or disputes.
• Listing accuracy, shipping issues, scams, or fraud.
• Platform downtime, bugs, or data loss beyond reasonable control.

Reasonable steps are taken to maintain functionality and security, but use of BST Airsoft is at the user’s own risk.

8. Moderation and Reporting

Inappropriate behavior or content may be reported using in-app tools. Reports are reviewed within 24 hours, with potential actions including content removal, warnings, or account suspension.

9. Termination

Access to the Service may be suspended or terminated for EULA violations or harmful activity. Except for severe violations (e.g., illegal activity, abuse), a warning or notice is typically provided before termination. Termination decisions can be appealed by visiting https://bstairsoft.com/contact-us/ within 7 days, with reviews completed within 48 hours.

10. Changes to This Agreement

This EULA may be updated at any time. Continued use of the Service after changes are published constitutes acceptance of the updated terms.

11. Field Listings and Third-Party Locations

Listings may be associated with local airsoft fields to coordinate meetups, provided for convenience only. Unless explicitly stated, airsoft fields are not affiliated with, do not endorse, and are not partners of BST Airsoft. Compliance with each field’s rules, obtaining necessary permissions, and following Section 2D safety guidelines are required when arranging meetups. BST Airsoft is not responsible for interactions or incidents at third-party locations.

12. Public Content and Profiles

BST Airsoft is a public platform. Users acknowledge that:

• Every account includes a public profile accessible on the internet.
• Display name, bio, and optional links are configurable through settings.
• Listings, listing images, and shared content are publicly viewable and may be indexed by search engines.
• Public content may be cached or redistributed by third parties.

Sensitive or personal information should not be posted. Content may remain visible after deletion if shared externally or cached.

13. Private Messaging

A private messaging feature is provided for user-to-user communication:

• Messages are not publicly visible and are accessible only to conversation participants.
• Messages are encrypted during transmission and stored securely.
• Messages are not end-to-end encrypted.
• Administrators may access messages to investigate abuse reports or enforce rules.
• Messages are never accessed arbitrarily or for personal interest.

Respectful communication is required, and message content may be reviewed for reported misconduct.

15. Geographic Restrictions

BST Airsoft is designed for use primarily within the United States, where airsoft-related transactions and data privacy are subject to federal, state, and local regulations. This U.S.-focused design simplifies compliance with laws governing airsoft equipment and user data. Access from outside the United States is permitted only if compliant with applicable local laws, including those related to airsoft ownership, sales, and data protection. No representations or warranties are made regarding the availability, suitability, or legality of the Service outside the United States, and access from other regions is at the user’s own risk and responsibility.

16. App Store License

The BST Airsoft iOS app is licensed, not sold, for use solely through the Apple App Store, subject to this EULA and the Apple Media Services Terms and Conditions (https://www.apple.com/legal/internet-services/itunes/us/terms.html). This license is non-transferable and limited to use on Apple-branded devices owned or controlled by the user, in accordance with Apple’s usage rules. All rights not expressly granted are reserved.

17. Privacy

BST Airsoft values privacy. The Privacy Policy, available at https://bstairsoft.com/privacy-policy, explains how personal information, including profile data, messages, and location information (if enabled), is collected, used, stored, and protected when using the BST Airsoft website, iOS app, or Android app. Use of BST Airsoft constitutes consent to the data practices described in the Privacy Policy. Non-essential data collection can be opted out through the Service’s settings or by visiting https://bstairsoft.com/contact-us/.

18. Governing Law

This EULA is governed by the laws of the State of Texas, United States, excluding its conflict of law provisions. Any disputes arising from this EULA will be resolved in the state or federal courts located in Travis County, Texas.

19. Intellectual Property

The BST Airsoft Service, including its design, logos, and content (excluding user-generated content), is owned by BST Airsoft and protected by copyright, trademark, and other laws. By uploading content, users grant BST Airsoft a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content solely for operating and promoting the Service.

20. Google Play License

The BST Airsoft Android app is licensed, not sold, for use solely through the Google Play Store, subject to this EULA and the Google Play Terms of Service (https://play.google.com/about/play-terms.html). This license is non-transferable and limited to use on Android devices owned or controlled by the user, in accordance with Google’s usage rules. All rights not expressly granted are reserved.

21. Severability

If any provision of this EULA is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
